{"id":15456,"date":"2024-12-16T13:51:24","date_gmt":"2024-12-16T13:51:24","guid":{"rendered":"https:\/\/central-law.com\/?p=15456"},"modified":"2024-12-16T13:51:24","modified_gmt":"2024-12-16T13:51:24","slug":"costa-rica-bereavement-leave-for-employees","status":"publish","type":"post","link":"https:\/\/central-law.com\/en\/costa-rica-bereavement-leave-for-employees\/","title":{"rendered":"COSTA RICA &#8211; Bereavement Leave for Employees"},"content":{"rendered":"<p>The Official Gazette of Costa Rica has published <strong>Law 10589<\/strong>, titled the &#8220;<em><strong>Law to Create Paid Bereavement Leave for Workers to Protect the Right to Mourn<\/strong><\/em>&#8220;, which introduces <em>subsection (l) to Article 69<\/em> of the Labor Code.<\/p>\n<p>This new subsection (l) establishes the right to paid bereavement leave for the death of family members as follows:<\/p>\n<p><strong>Three (3) working days for the death of immediate family members (first-degree relatives):<\/strong><\/p>\n<ul>\n<li>Parents<\/li>\n<li>Spouses<\/li>\n<li>Children<\/li>\n<li>Parents-in-law<\/li>\n<li>Sons-in-law and daughters-in-law<\/li>\n<\/ul>\n<p>In the case of common-law unions, the employee must provide a sworn statement affirming a cohabitation period of at least two years with the legal capacity to marry. For adoption cases, the employee must present documentation of the administrative or judicial ruling, or a final court decision, proving effective cohabitation with the minor for the purpose of adoption or formal adoption.<\/p>\n<p><em><strong>One (1) working day for the death of extended family members in the second or third degree of consanguinity or affinity:<\/strong><\/em><\/p>\n<p><strong>Second-degree relatives:<\/strong><br \/>\nGrandparents<br \/>\nSiblings<br \/>\nBrothers-in-law and sisters-in-law<br \/>\nGrandchildren<\/p>\n<p><strong>Third-degree relatives:<\/strong><br \/>\nGreat-grandparents<br \/>\nGreat-grandchildren<br \/>\nUncles and aunts (by blood or marriage)<br \/>\nNephews and nieces (by blood or marriage)<\/p>\n<p><strong>Important Considerations:<\/strong><br \/>\nThis law sets a minimum standard for all businesses in the country, regardless of their nature. Companies that already provide more generous bereavement leave\u2014through internal regulations, collective agreements, direct arrangements, customary practices, or other means\u2014must honor those terms.<\/p>\n<p>However, the benefit established by this law does not add to existing company policies.
